Ahead of the Uttar Pradesh Assembly polls, state Chief Minister Akhilesh Yadav has been declared the rightful owner of his Samajwadi Party's symbol, the cycle and the party name.

In an interim order ahead of seven-phase UP polls, the Election Commission said Akhilesh retains the most support within his party and hence is entitled to the symbol, reported India Today.

The Election Commission's legal experts looked into precedents and judgments before issuing the order. The Election Commission wanted to issue an order that could stand the test of courts.


Akhilesh has been in open feud with his father Mulayam Singh Yadav for control of the party.  Both sides filed competing claims with the Election Commission to use it as their own.

The Mulayam faction had argued over the legality of the Samajwadi Party convention called by Rajya Sabha MP Ram Gopal Yadav on January 1. Party patriarch Mulayam Singh called the meeting "unconstitutional" and later asserted that he is still the president.

The Akhilesh camp, on the other hand, claimed to enjoy the support of majority party legislators and hence told the Election Commission that it should be considered the real Samajwadi Party.

56 out 68 Members of Legislative Council and 4,716 of SP's 5,731 "delegates"— elected representatives of the party have backed Akhilesh.
