Smriti Irani's school records: Delhi HC stays the CIC order to provide information

The Delhi High Court on Tuesday stayed a direction by Central Information Commission (CIC) to reveal Union Minister Smriti Irani's school records.

Rejecting the concern of Central Board of Secondary Education (CBSE) that the sought information was "personal", the CIC on January 17 had asked the body to facilitate the inspection of Irani's Class 10 and 12 records and provide the certified documents to RTI applicant Mohammad Naushaduddin.


Justice Sanjeev Sachdeva, while hearing the plea filed by the CBSE against the Commission order, also issued a notice to Naushaduddin and fixed the next date of hearing on April 27.

The CIC had rejected the CSBE concerns that Smriti Irani's school records cannot be disclosed under the Right to Information (RTI) act as it was third party information held in fiduciary capacity.

The body had also asked the office of the Union Minister of Textiles and the Holy Child Auxilium School, to give the roll number or reference number Smriti Zubin Irani to CSBE, Ajmer which has the documents for years 1991 and 1993 to “facilitate search from huge records which is yet to be digitised”.
